1. GENERAL

These Terms of Sale apply to all purchases made through the online store at www.wedgwood.com (“Sites”), operated by FISKARS LIVING CANADA, INC. ("Fiskars," "we," "us," or "our").

These Terms of Sale govern the purchase relationship between you and Fiskars US. Your access to and use of the Sites is separately governed by our Terms of Use, which are incorporated herein by reference. By placing an order through the Sites, you confirm that you have read and agree to these Terms of Sale, our Terms of Use, our State Privacy Notice, and any additional terms applicable to specific promotions, products, or services.

If you have questions about a purchase, please contact our Customer Service team through our Contact Us Page. Please have your order number available when contacting us about a specific purchase. We handle inquiries relating to purchases made through our Sites only. For products purchased through a third-party retailer or physical store, please contact that retailer directly.

Any notices, disclosures, agreements and other communications relating to your use of the Sites will be provided to you electronically.

These Terms of Sale do not affect your statutory rights, which cannot be waived or limited by contract.

2. ORDERS

By placing an order through the Sites, you confirm that you are at least 18 years old and legally capable of entering into a binding contract. You must provide your full name, accurate shipping and billing addresses, phone number, email address, valid payment information, and any other information required to complete your order.

Our ordering process allows you to review and correct your order before submission. Once submitted, your order cannot be modified, including adding or removing items.

When you submit an order, you will receive an order acknowledgment by email. This acknowledgment is not an acceptance of your order and does not constitute confirmation of our offer to sell. Order acceptance and the formation of a contract between you and Fiskars US occurs when the ordered products are dispatched from our warehouse and you receive a shipping confirmation email.

3. ORDER ACCEPTANCE

We reserve the right to accept or decline any order at any time prior to shipment, for any or no reason, including product unavailability, pricing errors, or suspected fraudulent activity. We may also supply fewer units than ordered without prior notice. We may need to verify information you provide before accepting or processing your order. If we cannot accept your order, we will notify you and will not charge you, or will promptly refund any amount already charged.

4. PRICING, ERRORS, AND CORRECTIONS

All prices on the Site are in Canadian dollars (CAD). Applicable taxes are calculated and disclosed at checkout as described in Section 7. Prices are subject to change without notice, but the price at the time your order is accepted is the price that applies. Price changes will not be applied retroactively to accepted orders. Prices on the Site may differ from prices at our physical retail location(s) or third-party retailers.

Despite our best efforts, typographical or pricing errors may occur. If a product is listed at an incorrect price, Fiskars reserves the right to: (a) refuse or cancel any order placed at the incorrect price, whether or not the order has been confirmed; and/or (b) contact you to discuss the error before processing or shipping. If Fiskars cancels an order due to a pricing error, we will issue a full refund of any amount charged. You agree to notify us promptly if you become aware of any pricing or product description errors.

Pictures displayed on the Site are for illustration purposes only. Colors displayed may vary from the actual product depending on your monitor and display settings. Fiskars is not responsible for such color variations.

5. PAYMENT METHODS

We accept only certain payment methods which will be suggested when you proceed to payment. You can find more detailed information about the payment options here.

You will be required to provide the billing address and telephone number on file with your card issuer and, where applicable, your card's security code. Incorrect information may delay processing.

Your billing address must be within Canada, the United States of America, an EU or EEA country, Switzerland, the United Kingdom, Qatar, or the United Arab Emirates. Please note that you cannot use a billing address which is outside of these countries.

Unless otherwise provided in Payments, upon placing your order, we will require your card issuer or other payment service provider to place a funds provision on your card or other chosen method of payment. Your chosen mode of payment will be finally charged when your order is dispatched. We will not ship your ordered products to you until your card issuer or other payment service provider has authorized the use of your chosen mode of payment for these purchases. Please note that payments made via online banking (if available) will be charged immediately.

By providing payment information, you expressly authorize Fiskars US, its agents, and processors to charge your selected payment method for your order. Fiskars US protects your payment information using SSL encryption. We will not ship your order until your payment method has been authorized.

Please note that we reserve the right to cancel your order without prior notice if your chosen payment method cannot be debited.

6. PROMOTIONAL CODES

Promotional codes are valid only on the applicable Sites unless otherwise stated and subject to any specific terms communicated at the time of issuance. Promotional codes cannot be combined with other offers, discounts, or promotions unless explicitly stated. Promotional codes are valid until redeemed, expired, or withdrawn. We reserve the right to withdraw or cancel the promotion if deemed necessary by us after reasonable consideration. If an order is returned, we reserve the right not to reinstate the promotional code.

Personally issued promotional codes are non-transferable. Codes distributed or shared without our prior written approval are invalid and may be rejected or canceled.

7. TAXES

Where required by applicable law, Fiskars will collect and remit applicable federal and provincial sales taxes on purchases, including Goods and Services Tax (GST), Harmonized Sales Tax (HST), Provincial Sales Tax (PST), and Quebec Sales Tax (QST), based on your shipping destination. Applicable taxes will be calculated and disclosed at checkout before you complete your order. You remain responsible for payment of all taxes applicable to your purchase. 

8. SHIPPING

Fiskars ships to addresses in all Canadian provinces and territories. We do not ship to P.O. Box addresses. Please note that if you change the delivery country at the checkout, all the sections at the checkout (such as availability of products and offers, currency, price, tax rate, payment and shipping methods, Terms of Sale, etc.) will change accordingly, and orders are shipped to addresses in the selected delivery country.

Shipping and handling charges are in addition to product cost and will be calculated and disclosed at checkout before you complete your order. Fiskars reserves the right to impose a surcharge for certain large or heavy items, as noted on applicable product pages.

Your order will be shipped to the delivery or pickup location address provided during checkout, as confirmed in the order acknowledgment and shipping confirmation emails. Please note that changes to the delivery address cannot be made once the order has been placed. Please double-check your address before completing your purchase.
Orders are shipped as quickly as possible, subject to product availability. If a product is out of stock or unavailable, we will contact you to discuss next steps. We cannot guarantee specific delivery dates. During high-volume sales periods, longer delivery times should be expected.

If your order includes multiple products, items may be shipped in separate shipments at no additional charge.
In some cases, you may have the option to choose your preferred shipping provider or delivery method during checkout. We require you to provide a phone number during the ordering process so that the shipping provider can contact you, if necessary.

Title to products passes to you upon delivery to the carrier. Risk of loss passes to you upon delivery of the products to you or to a person you designate to take possession, other than the carrier. Please inspect your order upon receipt. If any product is damaged or your delivery is incomplete, please contact our Customer Service team  promptly.

We cannot be held responsible for delay or failure to perform if the delay or failure to perform is caused by circumstances beyond our reasonable control (i.e., force majeure). We will take all reasonable steps to prevent and minimize the delay caused by such circumstances. In the unlikely event of substantial delay, you will be entitled to cancel your order without additional charges.

If for any reason we cannot deliver your order within thirty (30) days of your placing it, we will inform you as soon as possible and you will be entitled to a full refund to the method of payment used by you.

9. RETURNS AND REFUNDS

You may return eligible products within 30 days of the date of purchase for a refund or exchange, provided the merchandise is new, unused, and accompanied by a properly completed returns form. Prepaid return shipping charges or postage are required for all returns.

You are responsible for any reduction in the value of the product (and any gift with purchase) due to handling beyond what is necessary to establish the nature, characteristics, and functioning of the product. If the product comes with packaging, please note that the packaging is important for resale. Any damage to the packaging or failure to return it will be considered a reduction in value.

If you received a gift with your purchase, you must return the gift with the product(s). If you do not return the gift and you no longer meet the conditions for receiving the gift, we will deduct its value from your refund.

Fiskars accepts returns only for products purchased directly through our Site. We do not accept returns for products purchased through third-party retailers, physical stores, or other online platforms. Personalized, custom, or engraved products are not eligible for return.

Refunds will be processed to the original payment method used for the purchase, promptly after we receive and inspect the returned product.

This return policy is offered in addition to, and does not limit, any rights or remedies you may have under applicable provincial or territorial consumer protection legislation.

If you are a resident of Quebec, you may have the right to cancel a distance contract and obtain a refund in the circumstances set out in the Quebec Consumer Protection Act. This includes, among other circumstances, where we have not provided the disclosures required before the contract is entered into, where we have not provided you with a copy of the contract, or where the products are not delivered within the time required by law. The cancellation period depends on the circumstances and may extend beyond the return period described above. If you cancel a distance contract in accordance with the Act and we do not refund the amounts owed to you within the time required, you may be entitled to request that your credit card issuer cancel or reverse the charge. These rights are in addition to, and do not replace, the return policy described in this Section.

For issues such as defects, missing items, or delivery problems, please contact our Customer Service team. To help us assess your claim, we may ask you to provide your order number and clear photographic documentation of the alleged defect or issue. Please retain the product until your claim has been processed. In some cases, we may ask you to return the product for inspection, and we will cover your reasonable return shipping costs for legitimate claims. Please keep proof of return, including tracking details. Nothing in this paragraph limits your rights under any applicable product warranty or under applicable provincial or territorial consumer protection or product quality legislation, including the legal warranty of quality under the Quebec Consumer Protection Act and the Civil Code of Quebec.

10. PRODUCT DESCRIPTIONS AND AVAILABILITY

Fiskars US attempts to ensure that product information on the Sites is accurate and current. However, we do not warrant that product descriptions, availability, or other content is accurate, complete, reliable, or error-free. Product availability and specifications are subject to change without notice. 

11. PRODUCT WARRANTY

Any express written warranty applicable to a product will be provided with or described on the product page for that product. For eligible products, Fiskars US also offers a limited breakage warranty, the terms and conditions of which are described in full on our Breakage Warranty Terms. Nothing in this Section affects any legal warranty or guarantee you are entitled to under applicable provincial or territorial consumer protection legislation.

12. OUR RIGHT TO CANCEL

We reserve the right to cancel your order if: (a) we do not receive or are unable to process your payment; (b) you provide inaccurate or fraudulent information; (c) a product is unavailable or mispriced; or (d) we are otherwise unable to fulfill the order. If we cancel your order, we will notify you and will not charge you, or will promptly refund any amount already charged.

13. WEBSTORE ACCOUNT

When you place an order on the Sites, an account is created for you. The account is linked to the email address you use when you place the order. All orders placed using the same email address will be registered and accessible to you in the account. Here you can find instructions on how to access your account and how to delete your account.

14. PERSONAL DATA

Personal information collected in connection with your purchase is governed by our Privacy Policy, which is incorporated herein by reference. We handle personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation, including Quebec's Act respecting the protection of personal information in the private sector (as amended by Law 25). Please note that the information you submit to the Site will be transmitted to and shared with authorized third parties that may be located in countries other than where you reside, in order to provide the services. 

Where personal information is transferred outside Canada, or outside Quebec for Quebec residents, it may be subject to the laws of the jurisdiction in which it is held, and we will handle such transfers in accordance with applicable Canadian and provincial privacy law.

15. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, FISKARS'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR IN CONNECTION WITH YOUR PURCHASE OR THESE TERMS OF SALE WILL NOT EXCEED THE AMOUNT YOU PAID FISKARS FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM. THIS LIMITATION DOES NOT APPLY TO ANY EXPRESS, WRITTEN PRODUCT WARRANTY PROVIDED BY FISKARS OR A MANUFACTURER.

IN NO EVENT SHALL FISKARS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR PURCHASE OR YOUR USE OF PRODUCTS OBTAINED FROM FISKARS, EVEN IF FISKARS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms excludes or limits Fiskars's liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable Canadian law, including applicable provincial or territorial consumer protection legislation. Where any provision of these Terms conflicts with your statutory consumer rights, your statutory rights prevail to the extent of the conflict.

16. INDEMNITY

You agree to indemnify, defend, and hold harmless Fiskars US and its affiliates and their respective officers, directors, employees, and agents from and against any and all claims, liability, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your purchase, your use of products obtained from Fiskars US, or your violation of these Terms of Sale.

17. DISPUTE RESOLUTION AND GOVERNING LAW

Any dispute arising out of or relating to these Terms of Sale or any purchase through the Sites is subject to the dispute resolution provisions in our Terms of Use.

18. MODIFICATIONS

Fiskars reserves the right to modify these Terms of Sale at any time. Changes will be posted to the Site with a revised effective date. The Terms of Sale in effect at the time your order is placed will govern your purchase.

If any provision of these Terms of Sale is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the largest extent permitted by respective applicable law. This shall not affect or impair the validity, legality, and enforceability of the remaining provisions.
